I guess its stating the obvious but the Real Estate industry is not best known for its high moral stance As we all know real estate agents use real estate websites and that they, generally speaking, end up paying very large amounts to be on those sites
Its not generally considered that agents not only totally rely on these sites but also actively lobby them to keep the publics own listings out. Its interesting to know that agents and the portals that they use have a vested interest in Unfortunately for the public the property portals and the agents they market listings for are far too close..
What this means quite simply is that fsbos just cannot compete and this is grossly inappropriate
Right now a property website in Australia has arranged to go expand on this inequality between fsbo or agent assisted sales and regulation property sales.
Not content to prohibit private sales the market power website has sought to hinder a small company which helps fsbos via an agent assisted sale. With no possibility to punish the grossly unfair impost the PropertyNow Australian portal has sought the intervention of the industry watchdog named the ACCC.
The lettering means Australian Consumer and Competition Commission. It is hoped and appears very likely that the market power will be found to have breached the laws that were designed to engender fair competition.
The rules are both powerful and enforceable. There are very serious financial impositions and other remedies that may take place if a company breaks the very onerous Anti-Competitive Laws.
It seems bizarre that an already powerful real estate website and one which is a recognisable would jeopardise its own business operations with the prospect of obtaining little of value even if it wins and one which in any case, has so little benefit.
It only needs a proof that the well known property site is in fact a Market Power, in order for the allegations to stick a factual breach of law.
If so then the market value of the company could fall dramatically.
If there is anything like that sort of happeningthe appetite for the fight might pass very quickly. The ruthless attempt to harm the littler site may prove highly both litigious and a PR nightmare for the bigger player.
The policies created by those who operate those real estate agent only property listing portals in an effort to keep sale by owner listings as banned listings are inevitably destined to come undone.
The efforts of real estate agent websites to keep the little guys out of the game is one thing, but when it begins to directly affect the public interest, then its an entirely different argument.
The ability of the agent only websites, to exclude private sellers will eventually fail At some point the portals and agents will need to accept the publics wishes.
The anti-competition laws should give the change a shot in the arm.
The cartel of real estate agency and property portals in order to keep the inequity is a international issue in in online property sales but bit by bit agents are beginning starting to lose their exclusive advantage and so private sellers are finding better and better results.
